The first-party/third-party distinction does not determine whether consent is required. In practice, most third-party cookies serve purposes that require consent (e.g., advertising), though some — like those strictly needed for federated login — may be exempt.

To be exempt from consent under Article 82 of the French Data Protection Act (Loi Informatique et Libertés), cookies or trackers must:

  • Be strictly limited to measuring the audience of the website or application (e.g., performance monitoring, error detection, technical optimization, ergonomic improvement, server capacity estimation, content analysis), and
  • Generate anonymous statistical data exclusively for the website publisher.

Conversely, they must not:

  • Enable tracking across different websites or applications. Any solution using a single identifier across multiple sites (e.g., third-party cookies used on several domains for reach measurement or data matching) is excluded from the exemption.
